1. What Milepost Is (and Is Not)

Milepost is a personal tracking tool for logging self-reported pain, range of motion, workouts, milestones, and related recovery data. Designed for runners, athletes, and active adults who want a private log of their comeback from injury.

Milepost IS:

• A self-logging tool for pain, ROM, workouts, and milestones.
• A way to see your own trends over time.
• A data export tool to share with your physical therapist, athletic trainer, physician, or coach.

Milepost IS NOT:

• A medical device. Milepost is NOT FDA-cleared, FDA-approved, or intended to diagnose, treat, mitigate, cure, or prevent any disease, injury, or medical condition.
• Medical advice. Nothing in Milepost constitutes medical, physical-therapy, athletic-training, nutritional, psychological, or health advice.
• A replacement for your doctor, PT, AT, coach, or any licensed professional.
• A prescription tool. Milepost does not prescribe exercises, treatment, or training plans.
• An emergency service. If you have a medical emergency, call 911 (US) or your local emergency number immediately.

You are solely responsible for your health, training, and recovery decisions. Always consult a licensed medical professional before making decisions about exercise, rehabilitation, return-to-sport, medication, or any health-related activity.

2. No Medical Advice

All content within Milepost — including exercise names, default categories, default milestone templates, help text, default ROM test descriptions, or any default content — is provided for informational and tracking purposes only.

• Do not rely on Milepost for medical decisions.
• Do not delay seeking medical attention because of information you read or log in Milepost.
• If you experience worsening pain, new symptoms, or any concerning change, contact a licensed medical professional immediately.

3. HIPAA & Health Privacy

Milepost is NOT a HIPAA-covered entity. We are a consumer wellness app, not a healthcare provider or business associate. Data you enter is protected by our Privacy Policy and applicable consumer privacy laws (CCPA, GDPR where applicable), NOT by HIPAA.

4. Eligibility

You must be at least 18 years old to use Milepost. We do not knowingly collect data from minors.

6. Acceptable Use

You agree NOT to:

• Use Milepost to harm yourself. If you are in crisis, contact 911 or the 988 Suicide & Crisis Lifeline.
• Use Milepost to diagnose or treat others.
• Attempt to reverse engineer, decompile, or copy the Service.
• Share your account with others.
• Spread medical misinformation through Milepost.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT MILEPOST WILL HELP YOU RECOVER FASTER, PREVENT REINJURY, IMPROVE YOUR PERFORMANCE, OR PRODUCE ANY SPECIFIC HEALTH OR ATHLETIC OUTCOME.

8. Limitation of Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

WE ARE NOT LIABLE FOR: personal injury from any activity you undertake; reinjury or failed recovery; misinterpretation of Milepost data by you, your coach, your PT, or any third party; lost profits, lost wages, lost data, or lost athletic performance; indirect, incidental, special, consequential, or punitive damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless PixelForge Studio LLC from any claim, liability, or expense arising from your use of the Service, your recovery or training decisions, or your violation of these Terms.

10. Governing Law & Arbitration

These Terms are governed by the laws of the United States and the state in which PixelForge Studio LLC is registered. Disputes resolved by binding individual arbitration under AAA Consumer Arbitration Rules. By using Milepost, you acknowledge that (1) you have read these Terms, (2) Milepost is a tracking tool, not medical advice, not a medical device, not a replacement for your doctor or PT, (3) you will consult a licensed professional before making recovery/training/return-to-sport decisions, (4) you accept the liability cap and arbitration terms, (5) you are solely responsible for any physical activity or health-related decision you make.
